Terms of Use & Course Enrollment Agreement

Welcome to The Sims Homeowner Academy, accessible via shelleyjsims.com. This Terms of Use and Course Enrollment Agreement ("Agreement") constitutes a legally binding contract between Shelley J. Sims, Licensed Real Estate Broker ("Broker," "I," "me," or "my") and you ("Student," "User," or "your") governing your access to and use of my online masterclasses, downloadable PDFs, calculators, and digital asset materials.

By registering for an account, accessing course players, or clicking "I Agree," you accept and agree to be legally bound by these terms. If you do not agree, you must immediately cease using the platform.

1. Scope of Services & Eligibility

• Platform Delivery: I grant you a limited, non-exclusive, revocable, non-transferable license to view educational videos and use materials for personal development.
• Age Requirement: You must be at least 18 years of age to register for an academy account or use my homebuyer resources.
• Geographic Scope: The market data, laws, contract explanations, and calculators are heavily customized for the state of Georgia. Use outside this jurisdiction is at your own risk.

2. Professional Disclaimer & No Broker-Client Relationship

• Educational Context Only: All masterclass modules, voiceover scripts, text blocks, and calculators are provided for general educational and informational purposes only.
• No Financial or Legal Advice: The contents of this academy do not constitute formal legal, financial, accounting, or mortgage underwriting advice.
• Agency Relationship: Enrolling in or completing courses inside The Sims Homeowner Academy does not establish a formal real estate broker-client relationship or exclusive buyer/listing agency agreement between you and Shelley J. Sims. A formal agency relationship is only formed when you sign a separate, written Brokerage Engagement Agreement as mandated by Georgia state law.

3. Earnings & Financial Calculation Disclaimers

• Calculators and Metrics: Interactive budget sheets and loan calculation models (such as the DTI Split, Bi-Weekly Hack Lab, or Net Proceeds Sheets) utilize automated math formulas based on static parameters.
• Real-World Variations: Actual underwriter approvals, interest rates, closing fees, title charges, municipal tax changes, and insurance premiums vary heavily based on personal credit scores and active real-time market data.
• No Guarantee of Profit: I do not guarantee any specific financial return, equity accumulation timeline, debt deletion result, or home sale profit margins.

4. Intellectual Property & Single-User Restrictions

• Proprietary Property: All video files, text scripts, customized visual assets, graphics, and pocket mini-books are my exclusive property and are protected by United States copyright laws.
• Strict Single-User License: Sharing your academy login credentials, video streams, or password codes with third parties is strictly prohibited.
• No Commercial Distribution: You may download standard student worksheet packages and checklists for personal use only (p. 34). You are explicitly forbidden from repackaging, copying, modifying, re-selling, or publishing my proprietary training templates online or offline without prior written authorization.

5. Accountability & Rules of User Conduct

To maintain access to my digital real estate campus, you agree not to:

• Deploy automated scrapers, web spiders, data extraction scripts, or malware against the platform server storage layers.
• Post defamatory, abusive, aggressive, or profane comments inside any public module discussion panels or social media engagement strings.
• Falsify personal identity parameters, contact information, email accounts, or financing metrics during the system screening intake quiz.

6. Account Termination & Modification

• Right to Terminate: I reserve the absolute right to suspend, freeze, or permanently erase your student profile and revoke access to the video masterclasses instantly, without notice or liability, if you violate any clause within this Agreement.
• Content Changes: I may update structural text materials, remove outdated lectures, swap out digital multi-tool architectures, or modify platform features at any time to remain compliant with changing real estate laws.

7. Limitation of Liability & Indemnification

• As-Is Platform: Access to the digital course host platform is provided on an "As-Is" and "As-Available" basis. I do not warrant that server connections, video streams, or system automation integrations (such as email delivery sync networks) will be entirely error-free or uninterrupted.
• Liability Cap: To the maximum extent permitted by applicable law, I shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from your reliance on course calculations, inspection checklists, or property staging suggestions.
• Indemnification: You agree to defend, indemnify, and hold me harmless from any claims, structural financial losses, liabilities, or legal expenses (including attorney fees) arising directly from your misuse of my masterclass materials or breach of this contract.

8. Governing Law & Dispute Resolution

• Jurisdiction: This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
• Arbitration Clause: Any dispute, claim, or legal controversy arising out of or relating to your use of this academy that cannot be resolved through informal negotiations shall be settled exclusively through binding arbitration administered in the state of Georgia.
